By making a booking at Bubblegum Studio Pte. Ltd. (“the Studio”), located at 100 Orchard Road, #02-53/54, Concorde Hotel and Shopping Mall S238840, you are deemed to understand, acknowledge and accept all terms of service set out hereunder.
Section 1: BOOKINGS
a. Booking shall be made via Bubblegum Studio online booking system up to 1 hour in advance. For last-minute booking, you may reach us via our Instagram account at @bubblegumstudiosg or email us at help@bubblegumstudiosg.com, subject to availability.
b. Revocation of bookings. The Studio (in its sole discretion) may revoke your bookings, at any time and without refund, in the event that you engage in behavior that is unsafe or objectionable to other customers, or for reasons of nuisance, disturbance to other customers, moral turpitude or fraud, or personal hygiene and attire. The Studio also reserves the right to require you to leave for the day if, in the Studio’s reasonable judgment, you pose a health or safety risk to you or others, or are disturbing or likely to disturb other customers.
c. Use Privileges. You must abide by the individual rules of the Studio.
Section 2: RISKS
a. Medical Recommendations. You are strongly advised to do sufficient warm-up before conducting any physical activities in the Studio. Do consult with your physician or to have a physical examination before using any of the Studio’s facilities, especially if you are pregnant, has a history of heart disease, high blood pressure, or other chronic illness, or is unaccustomed to strenuous physical exertion or has any other physical limitations that could create an increased risk of injury or adverse health consequences from strenuous exercise.
b. Customer Conduct. You shall not use any Studio facility, service, or equipment in such a way as to endanger the health or safety of yourself or others. You shall be responsible for any property damage or personal injury caused by yourself and/or your guests. You agree not to violate any laws while in any Studio facility and agree further to abide by all of the Studio’s rules and regulations, as they now exist and as they may be amended from time to time in the discretion of the Studio.
c. Customer Assumption of Risk. You acknowledge that the use of the Studio’s facilities might involve a risk of severe, permanent physical injury (including, without limitation, strained, sprained, or torn muscles, tendons or ligaments, broken bones, dislocation of joints, concussion, brain damage, nerve and spinal cord injury, and paralysis) and death. By using any of the Studio’s facilities, YOU WILLINGLY AND VOLUNTARILY ASSUMES ALL SUCH RISKS. The Studio cannot, and does not, guarantee that any facility or equipment is free of risk of any and all accidents or injuries of any kind (including death).
d. Medical Disclaimer. You have been informed and acknowledges that the Studio makes no claims as to medical or fitness results that can or may be obtained through the use of the Studio’s facilities, equipment, or services. The Studio has neither suggested nor will suggest any medical treatment to you. Only licensed medical professionals are qualified to give medical advice.
e. Customer’s Health Warranty. By using any of the Studio’s facilities, you represent and warrant that you (i) are in good medical and physical condition, and the use of the facilities does not pose any danger to your health; (ii) has no medical or physical conditions that would preclude your use of the Studio’s facilities, or otherwise create an increased risk of injury or adverse health consequences as a result of strenuous exercise; and (iii) has not been instructed or advised by any physician against conducting strenuous physical exercise or exertion, or using the Studio’s facilities.
f. Customer Waiver, Release, and Indemnity. By checking the box to signify agreement with the Terms and Conditions and/or by participating in Studio activities, you, on behalf of yourself, and on behalf of your heirs and assigns, expressly agree to forever discharge, waive and release Bubblegum Studio Pte. Ltd. and their respective members, officers, directors, affiliates, agents, employees and/or independent contractors (the “Released Parties”) from any and all claims, demands, injuries, liabilities, actions, causes of action and from all acts of active or passive negligence on the part of the Released Parties on account of any and all injuries or damages, including but not limited to bodily injury, mental injury, death and/or property damage from any event, mishap, accident, loss, damage or injury suffered resulting from or connected with or caused by the use of the Studio’s classes, services and facilities (including, without limitation, any of the dancing poles, or other equipment). You further agree, to the fullest extent permitted by law, to defend, indemnify and hold harmless the Released Parties from any and all claims, losses, and liabilities arising from, connected to, and/or arising from your use of the Studio’s services and facilities (including, without limitation, any of the dancing poles, or other equipment.) Additionally, you and your guests shall hold the Released Parties harmless from any loss, theft, cost, claim, injury, damage, or liability incurred as a result of their use of the Studio and associated activities.
g. Prevailing Party. In the event you commence an action against the Studio or its members, officers, affiliates, agents, or employees and fails to obtain a judgment or partial judgment in your favor, you shall be liable to the Studio for all costs and expenses associated with Studio’s defense of the action or any claims on which you did not prevail, including, without limitation, reasonable attorneys’ fees and costs.
h. Costs of Collection. You agree to pay all costs plus reasonable attorney and collection fees in connection with Studio’s (or Studio’s designee’s) collection of any amounts owed by you. Loss of Property. You are urged not to bring valuables onto the Studio premises and to keep valuables with you at all times. The Studio shall not be liable for the disappearance, loss, or theft of, or damage to, personal property (including money, negotiable securities, and jewelry).
Section 3: GENERAL PROVISIONS
a. Dancing Poles. Every dancing pole in the Studio has its own name. For individual booking, you are only allowed to use the pole you selected upon booking.
b. Customer and Guests Rules. You and your guests shall abide by the Studio’s rules and regulations and any amendments and/or modifications thereto.
c. Pets. In line with Concorde Hotel and Shopping Mall building management regulations, pets are not permitted in the Studio.d. Guest Rules. To maintain the privacy of other customers, guests are only permitted in the Studio upon permission of the Studio management. Please contact our customer care at help@bubblegumstudiosg.com for necessary arrangements.
e. Special Events. The Studio may from time to time reserve the use of its facilities for special events, workshops, photoshoots, and private functions.
f. Children’s use. All children under 18 years of age must be accompanied by a parent at all times within the Studio.
Section 4: MISCELLANEOUS
These Terms and Conditions and all rules and regulations of the Studio, as revised from time to time, constitute the entire and exclusive agreement between the parties, and supersede all prior promises, representations, understandings, and/or agreements relating to the subject matter hereof. This agreement may be modified only by an instrument in writing and only by the Studio.
Section 5: YOUR ACCOUNT
To access certain features of this Site, you may have to create an account. You are responsible for maintaining the confidentiality of your account username and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account. You are limited to only one account. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Bubblegum Studio Pte. Ltd. is not responsible for third-party access to your account that results from theft or misappropriation of your account. You must notify Bubblegum Studio Pte. Ltd. immediately of any breach of security or unauthorized use of your account. Bubblegum Studio Pte. Ltd. and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content at our sole discretion. Any creation of an account by, use of, or access to the Site by anyone under 18 is unauthorized, unlicensed, and in violation of these Terms. By using the Site you represent and warrant that you are at least 18 years of age and that you agree to abide by all of the Terms.
CANCELLATION, RESCHEDULING, AND REFUND POLICY
Cancellation and Refund. Your pole practice session is important to us and they are reserved especially for you. We understand that things may come up and you need some adjustments to your schedule. Bubblegum Studio Pte. Ltd. is happy to reschedule your booking made more than 8 hours and we will issue a studio credit equivalent to the amount of booking made.
Rescheduling. A request to reschedule a booking in less than 8 hours is difficult to fill, and when last-minute notice is given to us, you are preventing others to fill that time slot. Hence, we implemented a no-refund and no rescheduling policy within 8 hours of your reserved slot.
No Shows. When your booking is confirmed and you do not show up, you are automatically marked as a no-show in our system and no refund will be given.
SERVICE INTERRUPTIONS
Bubblegum Studio Pte. Ltd. will make reasonable efforts to keep the service operational. However, certain maintenance required for renovation or by relevant laws and regulatory requirements, may, from time to time, result in temporary service interruptions. Bubblegum Studio Pte. Ltd. reserves the right to temporarily or permanently discontinue the service, with advance notice wherever possible, all without liability to you.
COVID-19 SAFETY MANAGEMENT MEASURES (SMMs) – STUDIO GUIDELINES
A maximum of 2 persons is allowed at any given time inside the studio.
Participants are to ensure a 3-meters physical distancing while inside the studio.
Strictly no sharing of poles.
Mask-on for unvaccinated individuals should be practiced at all times. Mask-off if all participants are fully vaccinated. Mask-on if any one individual is unvaccinated.
All individuals are to adhere to fill up the body temperature declaration form provided in the studio at all times.
Any participants who are feeling unwell are requested to refrain from entering the studio and to visit the doctor immediately.
All participants are requested to clean the pole, crash mat, yoga mats/blocks, and floor area after every use using the disinfectant kits provided in the studio.
No eating is allowed. Drinking water is allowed to quench thirst.
No loitering. No intermingling. No spotting of other individuals.
All participants are requested to refrain from staying in the studio beyond their booking schedule.
SEVICE TERMINATION
You agree that Bubblegum Studio Pte. Ltd. shall have no liability or responsibility to you and will not refund any amounts that you have already paid, to the fullest extent permitted under applicable law.
